SwissFriends Terms of Service

Article 1 (Purpose)

These Terms aim to set out the rights, obligations, and responsibilities between Artfriends Inc. (the "Company") and Members in connection with the use of the SwissFriends service (the "Service") provided by the Company.

Article 2 (Definitions)

  1. "Service" means all services provided by the Company through the mobile app and website, such as the Switzerland travel information community and real-time chat.
  2. "Member" means a person who has entered into a use agreement with the Company and, having been granted an account via social login, uses the Service.
  3. "Non-member" means a person who uses the Service within the scope viewable without signing up.
  4. "Posting" means any content posted by a Member within the Service, including text, images, and files (including chat messages).

Article 3 (Publication and Amendment of the Terms)

  1. The Company publishes these Terms within the Service so that Members can easily become aware of them.
  2. The Company may amend these Terms to the extent that it does not violate relevant laws.
  3. When amending the Terms, the Company will announce the effective date and the reason for the amendment at least 7 days in advance (30 days in advance for changes that are unfavorable to Members or material).
  4. If a Member does not expressly indicate a refusal by the effective date of the amended Terms, or continues to use the Service, the Member is deemed to have consented to the amended Terms.
  5. Matters not stipulated in these Terms shall be governed by individual operating policies, relevant laws, and commercial custom.

Article 4 (Formation of the Use Agreement and Sign-up)

  1. The use agreement is formed when a Member applies to sign up in the manner prescribed by the Company (social login) and the Company accepts the application.
  2. Members must keep their information accurate and up to date, and must correct it without delay when it changes.

Article 5 (Restrictions on Sign-up and Reservation of Acceptance)

The Company may decline to accept a sign-up, or subsequently terminate the use agreement, in any of the following cases.

  1. Where another person's name or personal information is used
  2. Where a person who has received a suspension or sanction from the Company arbitrarily withdraws during that period and attempts to re-register
  3. Where there is falsehood, omission, or error in the sign-up information
  4. Where the person intends to use the Service for an improper purpose
  5. Where it is reasonably recognized that the sign-up violates the law or these Terms or is otherwise improper
  6. Where it is confirmed that a person under the age of 14 has signed up without the consent of a legal representative

Article 6 (Protection of Minors)

Persons under the age of 14 may not sign up or use the Service.

Article 7 (Protection of Personal Information)

  1. The Company complies with relevant laws such as the Personal Information Protection Act, and through its Privacy Policy discloses the items of personal information collected, the purpose of use, storage and destruction, delegation, provision to third parties, users' rights, and the like.
  2. For details regarding personal information processing, please refer to the Privacy Policy.

Article 8 (Provision, Change, and Suspension of the Service)

  1. The Company provides the following services.
    1. Switzerland travel information community and real-time chat service
    2. AI assistant and content services such as weather and travel information
    3. Other services determined by the Company
  2. The Company may change the content of the Service as required for operational or technical reasons, and will give prior notice of material changes.
  3. The provision of the Service may be temporarily suspended in unavoidable cases such as regular/temporary maintenance, communication failures, or force majeure. In such cases, the Company will give notice in advance or after the fact to the extent possible.
  4. Where the Company terminates the entire Service for material management reasons, it will give notice at least 30 days before the termination date.

Article 9 (Obligations of Members)

  1. Members must not engage in any of the following acts.
    1. Registering false information, misappropriating others' information, or duplicate sign-up
    2. Interfering with the operation of the Service or abnormal access
    3. Infringing the rights of other Members, the Company, or third parties (intellectual property rights, portrait rights, reputation, etc.)
    4. Creating postings that cause discomfort to other Members or that are contrary to public order, good morals, or the law, such as profanity, hate, obscenity, spam, or advertising
    5. Acts contrary to the law, these Terms, or operating policies
  2. If a Member violates this Article or violates these Terms or relevant laws, the Company may take measures such as restricting Service use, deleting postings, suspending the account, withdrawing membership, or claiming damages, depending on the severity of the violation.

Article 9-2 (Zero Tolerance for Objectionable Content and Abusive Behavior)

  1. The Company applies a zero-tolerance policy to objectionable content that causes discomfort to others — including violence, hate, sexual content, harassment, discrimination, and spam — and to abusive behavior toward other Members.
  2. Content that violates this policy will be removed within 24 hours of a report being received, and the account of the violating Member may be permanently suspended or ejected without prior notice.
  3. All Members may use the content reporting and user blocking features, and the Company reviews and acts on submitted reports. Content from a blocked Member is removed from the blocking Member's view immediately.

Article 10 (Management of Postings and Intellectual Property Rights)

  1. The Service and the intellectual property rights therein belong to the Company.
  2. Copyright in postings made by a Member belongs, in principle, to the Member. However, the Company may store, display, edit, and reproduce postings to the extent necessary for operating and promoting the Service. Members may request deletion or non-disclosure at any time.
  3. Postings that violate the law, infringe rights, or are contrary to operating policies, such as commercial spam, may be deleted or subjected to temporary measures without prior notice.

Article 11 (Account and Security)

  1. Responsibility for managing the social login account rests with the Member, and the account may not be transferred or lent to a third party.
  2. If misappropriation or leakage of the account is suspected, the Member must notify the Company without delay and follow the Company's guidance.

Article 12 (Withdrawal and Restriction of Use)

  1. A Member may request withdrawal at any time through My Page.
  2. Where a Member violates the law or these Terms or operating policies, or interferes with the normal operation of the Service, the Company may, after prior notice, restrict use or terminate the agreement. However, where there is an urgent reason such as a clear illegal act, the Company may take immediate action.
  3. Upon withdrawal or termination, Member information is destroyed except for information subject to a retention obligation under relevant laws, and chat messages and the like written by the Member may be retained in an anonymized state in which the author cannot be identified, for the normal use of other Members.

Article 13 (Dormant Accounts)

Accounts that have not logged in for one year or more may be separated and stored or destroyed in accordance with relevant laws such as the Personal Information Protection Act, and where necessary the Company will give notice, such as by email, before the transition.

Article 14 (Damages and Limitation of Liability)

  1. Where damage is caused to a Member by the Company's willful misconduct or gross negligence, the Company shall compensate for such damage in accordance with relevant laws and these Terms.
  2. The Company bears no liability for damage arising from causes not attributable to the Company, such as force majeure, communication failures, acts of God, or causes attributable to the Member.
  3. The Company provides the Service as an intermediary for community activities among Members, and responsibility for the content of postings made by Members and for interactions among Members rests, in principle, with the Member who created the relevant posting.
  4. Information provided by the AI assistant (weather, travel information, etc.) is for reference only, and the Company does not guarantee its accuracy or completeness.

Article 15 (Dispute Resolution)

  1. The Company operates a customer center to promptly handle Members' legitimate opinions and complaints.
  2. If a dispute arises, a Member may apply for dispute mediation through the relevant authorities.

Article 16 (Governing Law and Jurisdiction)

These Terms are governed by the laws of the Republic of Korea, and where a dispute arises between the Company and a Member in connection with the Service, the court having jurisdiction over the location of the Company's head office among the competent courts under the Civil Procedure Act shall have exclusive jurisdiction. As the Company's head office is located in Seocho-gu, Seoul, the Seoul Central District Court shall be the court of exclusive jurisdiction.

Article 17 (Notices and Notifications)

  1. The Company's mass announcements may be replaced by posting on the Service announcement board, and where individual notification is required, the Company will notify the Member via the contact information the Member provided (email, app push, etc.).
  2. Members must update their contact information without delay when it changes, and any disadvantage arising from failure to update rests with the Member.

Article 18 (Addenda)

  1. These Terms take effect on ____ , 20. (effective date to be confirmed)
  2. The Company may separately establish and announce detailed policies such as the Privacy Policy, and where they conflict with these Terms, an individual terms-of-use agreement requiring separate consent shall prevail.
